How Texas determines child support

A child support attorney in the San Antonio area can explain the mathematics used to determine payments. Texas law employs a series of charts and formulas taking into account the following:

  • How much child support a parent is owed or obligated to pay
  • Factors that might affect child support amounts in the future, such as illness or job loss

An experienced lawyer can guide you through the processes of calculating child support payments, obtaining a support order from the court and modifying your existing order. Call us before your spouse does.

To make a determination, the court considers your gross income from all sources and deducts the following expenses from that amount:

  • The medical insurance premium you pay for your children — not for yourself or your spouse
  • All your Social Security withholding
  • All your federal income tax withholding as a single person with one exemption and claiming the standard deduction

The resulting dollar amount is referred to as your net resource, which is multiplied by a certain percent according to the following guidelines:

  • One child = 20 percent
  • Two children = 25 percent
  • Three children = 30 percent
  • Four children or more = 35 percent

The net resource value is capped at $7,500 a month, meaning that the maximum child support payment for two children is $1,875 per month. However, the payer of child support must also pay the health insurance premium of the child.
